These General Contracting Terms and Conditions will govern the contractual relations established between the User and the company Golfspain Tours, S.L., holder of Taxpayer Identification Code (CIF) B82907700 and with registered office in Madrid, at C/ Segundo Mata, 1, regarding the service for the sale of green fees through the website www.teetimesbooking.com
The user expressly accepts the specific conditions of the golf course in which he/she registers, which are facilitated by the course directly to the player through its website.
These General Terms and Conditions have been prepared in accordance with the provisions of the General Contracting Terms and Conditions Act 7/1998, Defence of Consumers and Users Act 26/84, Royal Decree 1906/99 regulating Telephonic or Electronic Contracting with General Terms and Conditions, Personal Data Protection Organic Act 15/1999, Retail Commerce Act 7/96, Information Society and Electronic Commerce Services Act 34/2002 and other relevant applicable legal provisions in this regard.
1. Terms and Conditions of the Service
By accepting these General Terms and Conditions, the User/Customer expressly accepts full and unreserved adherence to them, as well as to the Specific Terms and Conditions that regulate the use of contracted services, stating that he/she has the legal capacity to contract the services provided by Golfspain Tours, S.L. This document may be printed and stored by the user, and clarification of its content may also be requested by calling the telephone number +34 91 351 24 15 or in writing by sending an email to golfspain@golfspain.com
Golfspain Tours, S.L. may at any time and without prior notice amend these General Terms and Conditions by posting such amendments on its website so that Users may become aware of them. Through the posting of the amendments on the website, it will be understood that the duty to notify them to Users has been fulfilled.
To access the contracting of the services offered on the website, the User must first fill in all the data requested in the form established for such purpose and click on the acceptance button.
2. Contracting procedure
2.1 Contracting
The parties expressly declare that the offer of Golfspain Tours, S.L. selected by the User/Customer will be accepted upon his/her completion of all the steps of the procurement procedure detailed on the website, which means full and express acceptance of these terms and conditions.
The contract will be perfected when the bank associated with the credit card provided by the Customer authorises the transaction. At this moment, a confirmation page of the booking made will appear, which can be printed as proof thereof.
By accepting the contract, the customer expressly accepts both the general rules of the game required by the Royal Spanish Golf Federation and the specific ones determined by the golf course where the customer acquires the green fee.
The terms and conditions and rates of the services offered are those that appear on the website upon contracting them. Golfspain Tours, S.L. may freely modify the rates without prior notice by posting them on the website. These rates will include VAT or any tax that may replace it, at the rate of tax established in each case by current legislation.
2.2. Golf services
The user/customer must respect the rules of operation and organisation established by the establishments in which the contracted golf services are provided. The acceptance of the offer by the user implies his/her express acceptance of these rules.
In the contracting of golf services, special consideration should be given to the federal regulations governing this sport, and in particular to the following issues:
Federative Golf Licence: to play golf on the course it is necessary to obtain the mandatory federation licence granted by the Royal Spanish Golf Federation (Telephone no.’s: 91 555 26 82 and 91 376 91 30, Fax: 91 556 32 90 e-mail: rfegolf@rfegolf.es), which includes civil liability insurance in the event of accidents during the practice of this sport. The booking of green fees to go out to play on the course implies the express declaration by the user that he/she is aware of federal regulations and has the required licence.
Handicap
Some golf courses may require the player to have a minimum handicap, proof of which must be provided when booking as well as on the course itself.
Green fees
The cancellation of the green fee contracted by the user less than 48 hours in advance will incur expenses of 100% of its cost, unless refunded by the Golf Course; in the event that the user does not turn up at the course at the time and on the day arranged, he/she will not be entitled to any refund whatsoever. If the agreed services cannot be provided due to force majeure (adverse weather conditions, closure of the course, repairs, etc.), the full amount of the service will be refunded subject to such circumstances being demonstrated.
3. Complaints
Any possible complaints or requests for clarification related to these terms and conditions must be addressed by email to golfspain@goflspain.com or expressed by telephone by calling the number +34 91 351 24 15.
4. Privacy and protection of personal data
Pursuant to Personal Data Protection Organic Act 15/1999, of 13 December, we inform you that the personal data obtained as a result of your registration as a user of the website will be incorporated into the files owned by Golfspain Tours, S.L., holder of Taxpayer Identification Code (CIF) B-82907700 and with registered office in Madrid, at C/ Segundo Mata 1. The files into which the data provided are incorporated have the security measures established in Royal Decree 1720/2007, of 21 December, implemented.
The user authorises the processing of the personal data provided, which is necessary for the provision of the agreed services, as well as for the sending of offers of other products and services, as provided in its privacy policy.
The information contained in this database is used both to correctly identify users who request the provision of the services offered through the website and to conduct statistical studies on registered users which make it possible to design improvements in the services provided, carry out basic administration tasks and communicate incidents, offers and news to registered users via email.
The user will be responsible, in any event, for the accuracy of the data provided, with Golfspain Tours, S.L. reserving the right to exclude from the registered services any user who has provided false data, without prejudice to other measures applicable under the Law.
All users may at any time exercise the right to access, rectify and, if necessary, cancel their personal data provided to Golfspain Tours, S.L., through a communication addressed to C/ Segundo Mata 1, in Madrid, by calling +34 91 351 24 15, or in writing by sending an email to golfspain@golfspain.com
5. Applicable legislation and conflict resolution
These General Contracting Terms and Conditions will be governed by Spanish law. In the event of any type of discrepancy or claim between the parties in relation to the compliance or content of these General Terms and Conditions, the parties submit themselves to the Courts and Tribunals of Madrid.
